Previously there was no right to carry forward untaken leave under the Working Time Regulations into the next holiday year (except for when leave could not be taken because of sickness or maternity or parental leave).
But the Regulations have been amended to allow workers to carry over untaken leave into the next two leave years where it is not ‘reasonably practicable’ for a worker to take some, or all, of the leave ‘as a result of the effects of coronavirus (including on the worker, the employer or the wider economy or society).’
This will only apply to the original basic four week leave period that was provided for in the Directive, but not to the additional statutory 1.6 weeks leave introduced in 2007.
